Delta Court Restrains Councilís Monthly Stipend To Monarch

Delta State Chief Judge, Justice Marshal Umukoro, has restrained the Oshimili South Local Council and the Delta State Government from releasing any amount whatsoever known and described as five per cent monthly stipend for traditional rulers in Oshimili South Local Government Area to His Royal Highness, Obi Prof. Chike Edozien, the Asagba of Asaba.

Justice Umukoro however ordered the Oshimili South Local Council and the Delta State Government to pay any unpaid fund known and described as 5% monthly stipend to traditional rulers in Oshimili South Local Council to the Assistant Director of the State High Court, Asaba, who shall deposit same into an interest yielding account in either Union Bank Plc, Asaba, United Bank of Africa (UBA) Plc Asaba, or Zenith Bank Plc, Asaba.


The orders of the Chief Judge resulted from the suit and motion on notice for an order of interlocutory injunction instituted by His Royal Majesty, Obi Anthony Osidi Onwuka, the Akor of Oko Anala, a recognised traditional ruler in the state who was presented with a staff of office on 29th December, 2012 by the Delta State Government.
The Claimant contended that between December 2012 and May 2016, the Asagba of Asaba converted the monies due to the royal fathers in the council solely to himself, depriving the claimant of his rights and legitimate earnings as a traditional ruler.
